Medical Considerations
When an employee presents a request as a result of a medical condition, it can be challenging to determine whether FMLA or ADA should be applied. It is critical that HR practitioners develop a pipeline that can provide guidance when making these decisions. A variety of resources may consist of shrm.org, ada.gov, and dol.gov/whd/fmla. All of these provide direction through related articles, publications, or case studies. Being well-equipped to ensure these decisions meet the needs of the employee, requirements of the law, as well as, protect your company is the targeted goal.
